Terms of Service

By accessing or using FTO Scout ("the Service"), operated by FTO Scout ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

FTO Scout is an AI-powered patent intelligence platform that assists users in conducting Freedom-to-Operate (FTO) searches, prior art analysis, and patent monitoring. The Service uses artificial intelligence to search patent databases and generate analytical reports.

You must be at least 18 years old and able to enter into binding contracts. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate and complete information when creating your account.

The Service is offered on a monthly subscription basis. Pricing is as displayed at the time of purchase. Subscriptions automatically renew each month unless canceled before the renewal date. A 7-day free trial is available for new subscribers. You may cancel at any time through the billing portal; access continues through the end of the current billing period. Refunds are not provided for partial billing periods.

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to reverse-engineer, decompile, or extract source code from the Service; (c) use automated scripts or bots to access the Service beyond normal usage; (d) share your account credentials with third parties; (e) use the Service to infringe on the intellectual property rights of others; or (f) submit content that is malicious, harmful, or violates any applicable law.

You retain ownership of all invention data, documents, and content you submit to the Service. We do not claim any ownership rights over your content. Reports and analyses generated by the Service are provided for your use, but the underlying algorithms, models, and platform remain our intellectual property. You may use generated reports for internal and professional purposes.

Your use of the Service is also governed by our Privacy Policy. Your invention data is stored securely and is not shared with other users. We use row-level security to ensure data isolation between accounts.

To the maximum extent permitted by law, FTO Scout and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, business opportunities, data, or goodwill, arising from your use of or inability to use the Service. Our total aggregate liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

You agree to indemnify and hold harmless FTO Scout and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the revised Terms.

We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. Sections 3, 7, 9, 10, and 14 survive termination.

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.
